FEDERAL / NATIONAL LEGAL NEWS - Maine "Light" Cigarette Case Revived

On Friday, a federal court ruling dismissing a Maine “light” cigarette lawsuit against Philip Morris was vacated by the 1st U.S. Circuit Court of Appeals.  The plaintiffs alleged that the marketing of “light” cigarettes violated Maine’s Unfair Trade Practices Law.  The district judge ruled in favor of Philip Morris based on the belief that the claims were pre-empted by the Federal Cigarette Labeling and Advertising Act.  The Court of Appeals found that the claims were not pre-empted by federal law, and returned the case back to federal court in Maine for further proceedings.
